General Terms and Conditions of Contract and Use

1. Service Provider Identification
These General Terms and Conditions of Contract and Use (hereinafter, "the Terms") govern the contracting and use of the services offered by Rabi Ouallam Jamladi, self-employed professional, in compliance with Spanish Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI-CE), owner of the domains mivpn.net and mivpn.es (hereinafter, "MiVPN").

2. Legal Framework
These Terms are governed by current Spanish and European legislation, including but not limited to:
- Spanish Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI-CE).
- Royal Legislative Decree 1/2007 of November 16 approving the revised text of the General Law for the Defence of Consumers and Users (TRLGDCU).
- Spanish Law 7/1998 of April 13 on General Contracting Conditions.
- Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of personal data (GDPR).
- Spanish Organic Law 3/2018 of December 5 on Personal Data Protection and Digital Rights Guarantee (LOPDGDD).
- Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes.
3. Subject Matter and Services
MiVPN offers digital services related to secure connectivity and virtual private networks, which may be contracted individually or within the same user account ecosystem:
- MiVPN: A service aimed at providing a personal VPN installed at home or in an office, with remote access to the local network and use of the user's original IP address where technically applicable.
- WiVPN: A service linked to a portable device or router with VPN connectivity via Wi‑Fi and/or Ethernet, managed from a web panel or compatible application.
- SiVPN: A VPN application service with connections to international locations and the features of a traditional VPN app.
Some services may require compatible hardware, specific software, a mobile app, a stable internet connection or specific operating systems, which will be indicated in each product description prior to contracting.
4. Acceptance and Capacity to Contract
By creating an account, subscribing to a plan, downloading software or using any of the services, the user declares to have read, understood and fully accepted these Terms, as well as MiVPN's Privacy Policy, Cookie Policy and Legal Notice.
Only persons over 18 years of age with full legal capacity to be bound under Spanish law may contract. If the user acts on behalf of a company or entity, they represent that they have sufficient authority to bind it contractually.
5. User Account
Access to the services may require creating an account and providing accurate, complete and up-to-date information. The user undertakes to keep such information current.
- The account is personal and non-transferable.
- The user is responsible for safeguarding their access credentials and maintaining the confidentiality of their password.
- The user shall be liable for all activity carried out from their account, unless there is evidence of unauthorised use not attributable to them.
- The user must notify MiVPN without delay of any unauthorised access, misuse or security incident detected.
- MiVPN shall not be liable for any damages resulting from the user's failure to fulfil their custody and confidentiality obligations.
6. Contracting, Prices and Taxes
Applicable prices will be those published on the website at the time of contracting. Before completing the order, the user will be shown a breakdown of the total price, including, where applicable, Value Added Tax (VAT) or other applicable indirect taxes, surcharges and any additional mandatory costs.
MiVPN reserves the right to modify its prices at any time. Price changes will not affect subscriptions already in progress until the next renewal, at which point the user will be notified with sufficient advance notice.
Services may be contracted through periodic subscriptions with recurring payments. By accepting these Terms, the user authorises the recurring charges associated with the chosen plan until they cancel the automatic renewal as provided in the following section.
7. Automatic Renewal
Unless otherwise stated in the product description or a specific promotion, subscriptions automatically renew at the end of each contracted period for a successive period equivalent to the original one, or for the period specified at the time of contracting.
MiVPN will send the user a pre-renewal notice with reasonable advance notice, indicating the amount to be charged and the expected renewal date.
The user may disable automatic renewal at any time before the billing date from their account panel or by contacting soporte@mivpn.net.
8. Billing and Payment Methods
Payments are processed through Stripe Payments Europe, Ltd. (hereinafter, "Stripe"), a third-party payment service provider based in Ireland and regulated as an electronic money institution by the Central Bank of Ireland. Stripe acts as a data processor for the management of the user's payment data in accordance with its own privacy policy, available at https://stripe.com/en/privacy, and its terms of service, available at https://stripe.com/en/legal.
MiVPN does not store or have direct access to the user's full credit or debit card details. Such data is managed entirely by Stripe under PCI-DSS security standards. The user warrants that the payment method used is valid, that they have sufficient funds and that they are authorised to use it.
Accepted payment methods may include credit or debit cards (Visa, Mastercard, American Express and other Stripe-compatible networks), as well as other methods enabled by Stripe from time to time depending on the user's region.
MiVPN may retry failed charges within the limits established by applicable regulations and use updated payment method information when provided by Stripe or payment networks, in accordance with applicable law and the conditions accepted by the user when registering their payment method.
Invoices or payment receipts will be available in the user's account panel or sent by email to the address provided at registration.
9. Free Trials and Promotions
Some services may offer free trial periods, promotional discounts or special launch prices. The specific conditions of each promotion will be clearly and prominently communicated before contracting.
If a promotion involves automatic conversion to a paid subscription at the end of the free or promotional period, this will be expressly stated and the user may cancel before the end of such period to avoid the corresponding charge.
10. Right of Withdrawal
Where the contracting party has the status of consumer under the TRLGDCU, they will have a period of fourteen (14) calendar days from the date of the contract to exercise their right of withdrawal without the need for justification and without penalty, in accordance with Article 102 et seq. of the TRLGDCU.
To exercise the right of withdrawal, the user must notify MiVPN by means of an unambiguous written statement sent to soporte@mivpn.net, stating their name, account details and order or contract number.
Exception applicable to digital content: in accordance with Article 103.m) of the TRLGDCU, the user will lose the right of withdrawal in respect of digital services provided by electronic means not supplied on a tangible medium if, during the withdrawal period, they expressly request that performance of the service begin, give their express consent to this and acknowledge that, as a result, they lose the right of withdrawal. MiVPN will obtain such acceptance unambiguously during the purchase process.
11. Refunds
Unless a specific offer provides otherwise or a different legal obligation applies, refund requests will be processed in accordance with the commercial policy in force at the time of contracting and, in all cases, respecting the rights recognised by consumer regulations.
In the event of an approved refund, access to the affected service may cease immediately or at the time the refund is processed, as applicable.
12. Rules of Use and Prohibited Uses
The user undertakes to use the services in a lawful, responsible manner consistent with these Terms. The following are expressly prohibited, among others:
- Using the services for unlawful, fraudulent or criminal activities of any kind.
- Carrying out DDoS attacks, hacking, phishing, pharming, distributing malware, system intrusion, brute force attacks or unauthorised access to third-party networks or computer systems.
- Sending spam, abusive mass campaigns or generating automated traffic that impairs the quality or availability of the service.
- Scraping or automated data collection without the express prior written authorisation of MiVPN.
- Infringing the rights of third parties, including intellectual property rights, privacy or personal data protection.
- Reselling, sublicensing, assigning or commercially exploiting the account or service without prior written authorisation from MiVPN.
- Using the services for military purposes, weapons proliferation or activities subject to applicable international sanctions.
- Transmitting, storing or disseminating unlawful, violent, discriminatory, abusive content or content that exploits or endangers minors.
- Circumventing, disabling or interfering with the security mechanisms, authentication or access controls of MiVPN's services.
13. Technical Monitoring and Anti-Fraud Measures
MiVPN may apply reasonable and proportionate technical controls to detect fraud, service abuse, malicious automation, scraping, unauthorised access attempts, excessive use incompatible with the contracted plan conditions or breaches of these Terms, always in compliance with applicable regulations and the Privacy Policy.
Such controls do not involve monitoring the content of user communications, but rather the supervision of technical service usage parameters.
14. No-Logs Policy and Service Limitations
MiVPN may commercially advertise a "no-logs" or enhanced log-minimisation policy for certain services, particularly in the VPN domain. The exact scope and technical conditions of such policy will be described in detail in the Privacy Policy and, where applicable, in service-specific technical documentation.
The user expressly acknowledges that use of MiVPN's VPN services does not render lawful any activities that are not permitted under applicable law, nor does it guarantee absolute anonymity against all technical or regulatory risks or those arising from actions taken by competent authorities in the exercise of their legal functions.
15. Availability, Maintenance and Support
MiVPN will make reasonable efforts to maintain service availability but does not guarantee uninterrupted availability or the complete absence of errors or incidents. Interruptions may occur due to scheduled maintenance, system updates, unforeseen technical incidents, force majeure events or third-party actions beyond MiVPN's control.
Where foreseeable, MiVPN will endeavour to communicate planned maintenance interruptions with reasonable advance notice. Technical support will be provided through the channels available on the website or via soporte@mivpn.net.
16. Software, Licences and Updates
MiVPN's software, control panels, applications, physical device firmware, documentation and other technological elements are licensed to the user, not sold. The user is granted a limited, revocable, non-exclusive, non-sublicensable and non-transferable licence for personal or internal professional use in accordance with the contracted plan, for the duration of the service and subject to these Terms.
MiVPN may publish updates, bug fixes, new versions or security patches at any time. Some service features may require the installation of the latest available version of the software or firmware.
Reverse engineering, decompiling, disassembling or any attempt to access the source code of MiVPN's software is expressly prohibited, except in cases expressly permitted by applicable law.
17. Intellectual and Industrial Property
All intellectual and industrial property rights in the services, software, firmware, trademarks, trade names, logos, designs, documentation, interfaces, source code, developments, content and underlying technology belong to MiVPN or its licensors and are protected by current Spanish and European legislation.
Access to or use of the services does not grant the user any ownership rights over such elements, nor does it imply any licence or assignment of rights beyond what is expressly provided in these Terms.
18. Suspension and Termination
MiVPN may temporarily suspend or immediately terminate the user's account and access to the services in the following circumstances:
- Non-payment or inability to collect amounts due after the corresponding charge attempts.
- Serious or repeated breach of these Terms.
- Reasonable indications of unlawful, fraudulent or abusive use of the service.
- Legal obligation or request from a competent authority requiring it.
- Serious risk to the security or integrity of MiVPN's or third parties' systems.
Where reasonable, proportionate and technically possible, MiVPN may first require the user to remedy the breach before proceeding with suspension or termination.
19. Disclaimer of Warranties
The services are provided "as is" and on an "as available" basis. To the extent permitted by applicable law, MiVPN does not warrant that the service will be uninterrupted, completely secure, error-free, compatible with all possible technical configurations or suitable for meeting all of the user's particular expectations. The legal guarantees to which the user is entitled as a consumer are preserved in all cases.
20. Limitation of Liability
To the maximum extent permitted by applicable law, MiVPN shall not be liable for indirect damages, loss of profits, loss of business, loss of data, business interruption or consequential damages arising from the use of or inability to use the services.
Where MiVPN is legally liable, such liability shall be limited to a maximum of the amounts actually paid by the user for the affected service during the twelve (12) months prior to the event giving rise to the claim, unless a mandatory rule provides otherwise.
Nothing in these Terms shall exclude or limit liability that cannot be excluded by law, including liability arising from wilful misconduct, fraud, gross negligence or personal injury, to the extent established by applicable mandatory legislation.
21. Third-Party Platforms (Apple App Store / Google Play)
When MiVPN applications are downloaded or contracted through the Apple App Store, Google Play or other third-party distribution platforms, the specific terms of those platforms may also apply, which the user must consult and accept independently.
Apple Inc., Google LLC or the relevant third party are not a party to or responsible for the provision of MiVPN's service. Functional support and contractual obligations of the service rest entirely with MiVPN, without prejudice to the purchase, cancellation or refund management procedures imposed by the distribution platform.
22. Cookies
MiVPN's website uses cookies and similar technologies. Their use, purpose and how to manage them are described in the Cookie Policy, available on the website, which forms an integral part of MiVPN's legal framework.
23. Personal Data Protection
The processing of the user's personal data is governed by MiVPN's Privacy Policy, which forms part of the contractual framework to the extent applicable and which the user declares to have read and accepted. MiVPN acts as data controller within the meaning of the GDPR and the LOPDGDD.
24. Customer Service and Complaints
For enquiries, technical issues, exercise of rights or complaints, the user may contact MiVPN through the following channels:

MiVPN undertakes to respond to complaints within a reasonable time and, in all cases, within the legally established deadlines.
In accordance with Regulation (EU) No 524/2013, users are informed that they may have recourse to the European online dispute resolution platform (ODR) for out-of-court resolution of disputes: https://ec.europa.eu/consumers/odr.
25. Modifications to the Terms
MiVPN may modify these Terms at any time to adapt them to regulatory, technical, commercial or security changes. Modifications that materially affect the user's rights or obligations will be communicated by reasonable means (email, notice in the account panel or notification on the website) with a minimum of thirty (30) days' notice before taking effect, unless an urgent regulatory change requires immediate implementation.
Continued use of the services after the modifications take effect will constitute acceptance of the new terms. If the user does not accept the changes, they may terminate the contract before the effective date without penalty.
26. International Contracting
26.1. Geographic Scope of Services
MiVPN offers its VPN application service (SiVPN) to users worldwide. Products that include a hardware component (MiVPN, a VPN server for home or office installation, and WiVPN, a WiFi router with integrated VPN) are sold exclusively in Spain for physical shipment. MiVPN reserves the right to expand hardware distribution to other territories in the future, which will be communicated on the website in due course.
MiVPN also reserves the right to restrict access to or contracting of any of its services from certain countries or territories for legal, technical or commercial reasons, without prior notice.
26.2. Taxes, VAT and Tax Obligations by Country
Prices displayed on the website may include or exclude indirect taxes (VAT, GST or equivalents) depending on the user's country of residence or establishment and applicable tax regulations.
For users located in the European Union, the applicable VAT will be that of the consumer's country of residence, in accordance with EU VAT regulations for digital services (OSS/MOSS). The final amount including taxes will always be shown in a breakdown before completing the purchase.
For users located outside the European Union, prices may be displayed without Spanish VAT. The user will be responsible for complying with the tax obligations applicable in their country of residence or establishment under their local legislation. MiVPN is not responsible for the user's tax compliance obligations in third countries.
26.3. Legal Restrictions on VPN Use by Country
The use of VPN services is subject to different regulations depending on the country from which they are accessed. In some countries, the use of VPNs may be restricted, regulated or partially or wholly prohibited by local law.
It is the user's sole responsibility to be informed of and comply with the regulations in force in their country of residence or from which they access the service before contracting or using any of MiVPN's services. MiVPN does not guarantee that the use of its services is lawful in all countries and accepts no liability for use of the service in jurisdictions where it is partially or wholly prohibited or restricted.
For informational purposes only and without constituting legal advice, users are advised that countries such as China, Russia, Iran, North Korea, Belarus, Iraq, Oman, Turkmenistan and Uganda, among others, impose significant restrictions on VPN use. This list is not exhaustive and may change. Users must verify the legal situation in their jurisdiction before contracting.
26.4. International Sanctions
MiVPN complies with applicable international sanctions regulations, including those established by the European Union, the United Nations and the United States Office of Foreign Assets Control (OFAC), as well as any other applicable sanctions regulations.
The contracting or use of MiVPN's services is expressly prohibited by:
- Natural or legal persons included on EU, UN, OFAC or equivalent sanctions lists.
- Users located in countries or territories subject to comprehensive embargoes or sanctions (including, without limitation, North Korea, Iran, Cuba, Syria and the regions of Crimea, Donetsk and Luhansk).
- Entities directly or indirectly controlled by sanctioned persons or countries.
MiVPN reserves the right to immediately block, suspend or terminate access to the service, without liability, when it detects or reasonably suspects that a user falls within any of the above circumstances, and may retain amounts paid where required by applicable regulations.
26.5. Contract Language and Translated Versions
These Terms are drafted in Spanish, which is the official and binding version of the contract. MiVPN may make translations into other languages available for informational and accessibility purposes only.
In the event of any discrepancy, contradiction or conflict between the Spanish version and any available translation, the Spanish version shall prevail in all cases. Users contracting from a non-Spanish-speaking country declare that they have understood the content of the Terms or have obtained the necessary assistance to do so, and may not invoke lack of understanding of the language as grounds for nullity or unenforceability of the contract.
27. Severability
If any provision of these Terms is declared null, invalid or unenforceable by a final judicial or administrative decision, such nullity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The parties undertake to replace the affected provision with a valid one that reflects the original intent as closely as possible.
28. Applicable Law and Jurisdiction
These Terms are governed entirely by Spanish law.
Where the user has the status of consumer under the TRLGDCU, the courts of the user's place of domicile or those provided by applicable consumer law shall have jurisdiction, and the mandatory consumer jurisdiction shall prevail in all cases.
In all other cases, unless a mandatory rule provides otherwise, the parties expressly waive any other jurisdiction that may apply to them and submit to the Courts and Tribunals of Pontevedra.
